Terms of Service

1.1 Acceptance of Terms

By purchasing, activating, or using a Digiboo device (“Device”) or its companion AI software (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not purchase, activate, or use the Device.

1.2 Eligibility — Minimum Age 13, Guardian Setup Encouraged

You must be at least 13 years old to use Digiboo. Digiboo is strictly not for use by anyone under 13, with no exceptions.

At first setup, the Device presents an age gate and asks the user to confirm their age before the AI companion becomes active.
For users under 18, we encourage having a parent or guardian complete the initial device setup, and the setup flow will prompt for this.
Digiboo relies on the age information provided at setup. We cannot independently verify a user's age or confirm that setup was actually completed by an adult, and we do not represent that our age gate constitutes verified age or identity confirmation. Digiboo is not responsible for a user misrepresenting their age or a minor bypassing the guardian-setup prompt; however, this does not permit use by anyone under 13, and knowingly misrepresenting age to circumvent the under-13 restriction is a violation of these Terms.
If we become aware that a Device is being used by someone under 13, we will suspend or terminate that unit's access to the Service.
Parents/guardians: if a Device in your household is being used by a child under 13, contact our support so we can assist with account-level restrictions.

1.3 Nature of the Service

Digiboo provides access to an AI-driven conversational companion and assistant, displayed through avatar characters on a physical display device. Digiboo is designed as a friend-style companion and assistant, not a romantic or intimate product.
All avatar characters are fictional and AI-generated or AI-rendered. They do not depict, represent, or correspond to any real person, living or deceased.
The Service is persistently and clearly identified as artificial intelligence. The app displays a constant, non-dismissible banner or indicator reminding users they are interacting with AI, not a human. Digiboo does not have real emotions, memories, or consciousness, and does not provide professional advice of any kind (medical, mental health, legal, financial, or otherwise).
Digiboo is not a substitute for human relationships, therapy, or crisis support. The Service includes built-in guardrails designed to recognize expressions of self-harm or suicidal ideation and to direct users to crisis resources (e.g., in the U.S., 988). If you are experiencing a mental health crisis, please contact a crisis line or emergency services directly — Digiboo is not equipped to handle emergencies.

1.4 Avatar Licensing

Digiboo uses a compiled library of avatar assets licensed or made available for use under free-use / royalty-free terms. Digiboo does not claim original authorship or exclusive ownership of underlying avatar artwork and makes no representations regarding third-party rights beyond the licenses it has obtained. If you are the original author of an asset used in our library, contact our support with details and we will remove it from our library going forward.

1.5 Acceptable Use

You agree not to:

Attempt to bypass, disable, reverse-engineer, jailbreak, or otherwise circumvent Digiboo's safety systems, content filters, or usage restrictions.
Use the Device or Service to generate, request, or engage in discussion of illegal content, including but not limited to content involving minors in any sexual or exploitative context, non-consensual content, terrorism or violent extremism, illegal weapons or drug manufacturing, or any other unlawful act.
Use the Service for any activity that violates applicable local, state, federal, or international law.
Attempt to extract, copy, or repurpose the underlying AI models, training data, or software beyond ordinary end-user use of the Device.
Resell, sublicense, or commercially redistribute access to the Service without written authorization.

Digiboo enforces this section through automated protections rather than manual review: rate limits on requests to prevent abuse of our servers, and built-in AI guardrails designed to decline or redirect illegal or unsafe requests. Attempting to circumvent these protections is itself a violation of these Terms and may result in suspension or termination of access.

1.6 Data Handling — Device Storage vs. Server Processing

Your conversation history is stored locally on the Device. When a message is sent to the AI, it is transmitted to our servers solely to generate a response; our servers use that content only for that purpose and do not retain, log, or otherwise use it afterward. 1.7 Intellectual Property

The Device hardware, firmware, software, and Digiboo branding are the property of Digiboo and its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. All other rights are reserved.

1.8 Disclaimers

The Device and Service are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. AI-generated responses may be inaccurate, unpredictable, or inappropriate; Digiboo does not guarantee the accuracy, reliability, or appropriateness of any AI output.

1.9 Limitation of Liability

To the maximum extent permitted by law, Digiboo and its officers, employees, and affiliates are not liable for indirect, incidental, consequential, special, or punitive damages arising from use or inability to use the Device or Service. Digiboo's total liability for any claim arising from these Terms or the Service is limited to the amount you paid for the Device in the 12 months preceding the claim.

Note: this limitation cannot and does not waive liability where prohibited by law — for example, liability arising from Digiboo's own negligence, defective products, or (per emerging state law) harm caused by the AI system itself cannot always be disclaimed by contract.

1.10 User Responsibility

You are responsible for your own use of the Device, including choices made in reliance on AI-generated conversation, and for supervising Device access within your household to ensure it is not used by anyone under 13. For users under 18, we encourage ongoing parental or guardian supervision of Device use. Digiboo is not responsible for damages arising from misuse, unauthorized modification, use by someone under 13, or use of the Device in violation of these Terms.

1.11 Indemnification

You agree to indemnify and hold Digiboo harmless from claims, damages, or expenses (including reasonable attorney's fees) arising from your violation of these Terms or your misuse of the Device.

1.12 Termination

Digiboo may suspend or terminate your access to the Service at any time for violation of these Terms, illegal use, or safety concerns, with or without notice.

1.13 Governing Law & Disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles.

1.14 Changes to Terms

Digiboo may update these Terms from time to time. Continued use of the Device after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated via email or device notification.
